Probate

In California, Probate Attorney fees and Executor commissions are determined by California Probate Code §10800 & 10810 and are based on the gross value of the estate.

California Probate Code section 10800 provides a formula for determining the attorney fees in probate. The formula is as follows:

  • 4% of the first $100,000 of the estate's gross value

  • 3% of the next $100,000

  • 2% of the next $800,000

  • 1% of the next $9 million

  • 0.5% of the next $15 million

There are provisions that allow the court to adjust the attorney fees if the estate is particularly large or small or if the attorney's services involved extraordinary work or complexity.

California Probate Code section 10810 establishes the guidelines for executor commissions. The commissions are based on the value of the estate and are calculated as follows:

  • 4% of the first $100,000

  • 3% of the next $100,000

  • 2% of the next $800,000

  • 1% of the next $9 million

  • 0.5% of the next $15 million
